SAY ?AHHHH?: NEW HEALTH AND WELLNESS CENTER INCLUDES SPACE FOR ACADEMICS, FITNESS AND ATHLETIC TRAINING

TALLAHASSEE, Fla. ? Florida State University students who stream into the atrium of the campus?s new, 170,000-square-foot Health and Wellness Center aren?t just there for the usual treatment of sore throats and sprained ankles.

The light-filled building has ample space for advanced medical care. But unlike its predecessor, Thagard Student Health Center, the new Health and Wellness Center includes classrooms, research laboratories, even physical therapy and athletic training ? all under one roof.

The Health and Wellness Center was a decade in the making and ambitious in its collaborative goals, said Lesley Sacher, director of University Health Services, which is a partner in the facility.

?This is a grand experiment in an environment where resources are shrinking,? Sacher said. ?We asked ourselves: If we put the students at the center of the service wheel, how can ?like? departments come together and make this as multi-purpose as possible??

As a result, the center not only fulfills its mission of providing first-rate care for students but its classroom spaces are booked and its labs play host to health-related research ? including a concussion clinic that will allow Florida State athletic training students to study the sports-related injury in a College of Medicine research project.

In addition to University Health Services, partners in the Health and Wellness Center are the College of Nursing, Campus Recreation and the College of Human Sciences. They have collaborated in myriad ways ? from staffing to academics ? to maximize the center?s offerings.

A new Priority Clinic will help students get more effective treatment; additionalclinic space will provide an additional 50 appointments per day during the first semester of operation, which began Aug. 27. Ultrasound and digital radiology services will also be expanded, and a partnership with Tallahassee Memorial Hospital?s Diabetes Resource Center has grown as well.

?Our capacity for care has increased through additional examination rooms,? Sacher said. ?Each department is able to dedicate several exam rooms per clinician to be more efficient.?

The Health and Wellness Center also features a nursing triage clinic for same-day appointments and a healing garden for personal reflection. And an urgent-care dispensing system soon will be available to students who do nothave transportation to off-campus pharmacies.

The new center provides significant and technology-rich student space for graduate assistants and undergraduates working in health promotion and health policy ? yet another bonus not found in a traditional student health center.

?We dreamed about a facility that would promote a sense of well-being and that would address a student?s intellectual, emotional, physical and spiritual development,? Sacher said.

The new facility replaces Thagard Student Health Center, named simply the Student Health Center when it opened its doors in 1966. In the years after the construction of Thagard, student enrollment at FSU swelled from 15,000 in 1966 to about 40,000 this semester. Each floor of Thagard had to be renovated in the 1990s and 2000s to adapt to new code requirements, the advance of technologies and utilization changes.

By 2001 it was clear that student growth was outstripping University Health Services? ability to provide service to the campus community, and plans for the Health and Wellness Center began. ###

Fidelity in marriage an issue for gay men ? NZ Herald article by ...

All you need is love. That is the theme song of pro-same-sex marriage proponents. It is the slogan of Louisa Wall, author of the same-sex marriage bill. If two gay people love each other and want to ?marry?, why don?t we allow this? But is love enough?

In answering that question, we need to be aware of two other questions: what is marriage? And why is the state involved? The latter question is crucial, because the core issue is one of affirmation, not rights ? rights can be dealt with by specific legislation without amending the Marriage Act and upsetting lots of people.

Apart from conveying rights, marriage provides affirmation that the state/society encourages this relationship as a good thing. A crucial question is whether gay relationships are such a good thing as to be endorsed by society as ?marriage?.

We should look at the issue of social endorsement through four lenses: love, commitment, health, and society?s interests.

Let?s begin with love. What is ?love?? The word covers a raft of sometimes contrary meanings, from sexual desire centred on ?my? self-gratification, to heroic self-giving for another. Both heterosexual and same-sex unions may well pass (or fail) this test. The love issue does not debar same-sex marriages.

However, love alone is not enough. It can be fleeting and transient. If marriage is to be serious and not trivial, it needs longevity, buttressed by commitment and faithfulness.

What of gay commitment and faithfulness? Long-term lesbian relationships on average may well be as committed and faithful as that of an average married heterosexual couple. The problem is the gay men.

Some male gay couples are as committed and faithful as typical married heterosexuals. Survey evidence, however, indicates that these are very much a minority.

Significant data on male homosexual behaviour is available through New Zealand Medical Journal articles and the New Zealand Aids Foundation website. The Aids Foundation and the Aids Epidemiology Group at the University of Otago have conducted biennial surveys, the Auckland Gay Periodic Sex Surveys, for the past decade.

The 2010 results covered the sexual behaviour of 1527 gay men in 2008. On the commitment side, the survey indicates that the most common number of sexual partners for gay men over the previous six months was two to five. Just 38.8 per cent of those surveyed had a partner of more than six months? standing (i.e. relationships with some level of commitment).

However, 52 per cent of these men had also had sex in that period (six months) with other partners. So despite the rhetoric of love and commitment, most male gay couples are not in a genuinely monogamous relationship. Should the meaning of ?marriage? be broadened under such circumstances?

There is also the health issue. Male-to-male coupling typically has far greater health risks (because of high levels of anal sex). Both with casual and with ?boyfriend? sex the percentage engaging in anal sex is over 80 per cent. Anal sex is never fully safe. Although condoms reduce the risk of sexually transmitted diseases (including HIV/Aids) by around 85-90 per cent, risk remains (because of user misuse or product failure).

Risk is far greater without condom protection. Although 98 per cent of those surveyed knew that anal sex without a condom is very high risk for HIV transmission, 73 per cent did not use a condom at least once in the past six months (the figure for casual sex was 31 per cent).

The result is high levels of sexually transmitted infections amongst gay men. Over 60 per cent of new infectious syphilis cases are gay men. This category also has high rates of gonorrhoea and hepatitis. And 76 per cent of all new HIV diagnoses in 2000-2009 were gay men.

Can we affirm male gay relationships to the level of ?marriage?, given the data on faithfulness and health? One can argue change on the basis of ?me?, ?my rights? and ?choice?. But the debate is also about the good of society.

What society needs are stable, faithful, healthy relationships. Stable marriage has gravely weakened in the last generation. There is deep hurt and scarring of many, especially children, as a consequence.

In a direct sense gay ?marriage? will not make this worse. Indirectly, however, it will, because it makes marriage, which for many is becoming vague and fuzzy, vaguer and fuzzier still. It is social engineering ? with its negative aspects ignored.

We need to have a deep and wide debate, looking at all factors. The same-sex marriage debate is currently far too simplistic. The draft bill is a daft bill.

Photonic interactions measured at atomic level

ScienceDaily (Aug. 30, 2012) ? By measuring the unique properties of light on the scale of a single atom, researchers from Duke University and Imperial College, London, believe that they have characterized the limits of the ability of metals to be used in devices that rely on the enhancement of light.

This field is known as plasmonics because scientists are trying to take advantage of plasmons, electrons that have been "excited" by light in a phenomenon that produces electromagnetic field enhancement. The enhancement achieved by means of metals at the nanoscale is significantly higher than that achievable with any other material.

Until now, researchers have been unable to quantify plasmonic interactions at very small sizes, and thus have been unable to quantify the practical limitations of light enhancement. This new knowledge should help in the development of devices, such as medical sensors and integrated photonic communications components, since scientists will have a roadmap for precisely controlling the scattering of light.

Typically, plasmonic devices involve the interactions of electrons between two metal particles separated by a very short distance. For the past 40 years, scientists have been trying to figure out what happens when these particles are brought closer and closer, at sub-nanometer distances, according to the Duke electrical engineers.

"We were able to demonstrate the accuracy of our model by studying the optical scattering from gold nanoparticles interacting with a gold film," said Cristian Cirac?, postdoctoral fellow at Duke's Pratt School of Engineering. "Our results provide a strong experimental support in setting an upper limit to the maximum field enhancement achievable with plasmonic systems."

The results of Cirac? and co-workers' experiments, which were conducted in the laboratory of senior researcher David R. Smith, William Bevan Professor of electrical and computer engineering at Duke, were published in the journal Science as the cover article.

In their experiments, Cirac? and his team started with a thin gold film coated with a ultra-thin monolayer of organic molecules, studded with precisely controllable carbon chains. Nanometric gold spheres were dispersed on top of the monolayer. Essential to the experiment was that the distance between the spheres and the film could be adjusted with a precision of a single atom. In this fashion, the researchers were able to overcome the limitations of traditional approaches and obtain a photonic signature with atom-level resolution.

"Once you know maximum field enhancement, you can then figure out the efficiencies of any plasmonic system," Smith said. "It also allows us to 'tune' the plasmonic system to get exact predictable enhancements, now that we know what is happening at the atomic level. Control over this phenomenon has deep ramifications for nonlinear and quantum optics."

The Duke team worked with colleagues at Imperial College, specifically Sir John Pendry, who has long collaborated with Smith.

"This paper takes experiment beyond nano and explores the science of light on a scale of a few tenths of a nanometer, the diameter of a typical atom," said Pendry, physicist and co-director of the Centre for Plasmonics and Metamaterials at Imperial College. "We hope to exploit this advance to enable photons, normally a few hundred nanometers in size, to interact intensely with atoms which are a thousand times smaller."

The research was supported by the Air Force Office of Scientific Research and by the Army Research Office's Multidisciplinary University Research Initiative (MURI).

The other members of the team were Duke's Ryan Hill, Jack Mock, Yaroslav Urzhumov and Ashutosh Chilkoti; and from Imperial College, Antonio Fern?ndez-Dom?nguez and Stefan Maier.

Black Fitness Today is proud to present a new feature called ?Life Changers,? spotlighting African-Americans who have made a commitment to improving the lives of others through health and fitness.

This month?s ?Life Changers? spotlight features Zumba instructor Cristin Wood. The Shaker Heights, Ohio native currently living in Norfolk, Virginia talked to us about her personal health and fitness journey, and what inspired her to become an instructor.

Q. When did you start getting serious about your health?
A. In October 2010 I started training for my first half marathon with a group called Team In Training. We help raise money for the Leukemia and Lymphoma Society by training for endurance events.? After each run, I would post my mileage on Facebook and Twitter. The feedback I received was amazing! People I didn?t even know told me that I inspire them.?When others started taking my fitness journey seriously, I was forced to do so as well.

Q. Tell us about your journey to becoming a Zumba Instructor and what you enjoy most about it.
A. My journey is a little different than most.?I didn?t like Zumba and couldn?t understand what all of the hype was about.? I have a dance background so when I watch other people dance, I?m a tough critic. It seemed that the instructors of every class I went to had NO rhythm and that drove me CRAZY! In April of 2011, I was in San Diego for work, and my friend convinced me to try Zumba at her gym and it finally clicked.?The instructor had so much energy and I felt like I was at a party!? From that moment, I knew I could be an instructor too.

I love having the opportunity to inspire my students in each class while doing something I enjoy! Additionally, I have a Zumba box that is filled with quotes, scriptures and inspirational messages.? At the end of class, students come and take a card that is made to nourish them mentally after being challenged physically.?

Q. What is your current workout routine?
A. This sounds like a lot more than it is ? but I am finishing my 4th week of Insanity, running three times a week to train for a half marathon and teaching Zumba 1-2 times a week.?I?ve lost 30 pounds so far and have 15 more to go.

Q. What does health and fitness mean to you?
A. To me, health and fitness is a journey to become your best self. No matter how smart you are or?what legacy you want to leave, you can?t accomplish anything if you have poor health.?When I exercise and eat right I sleep better, have more energy, think more clearly, am more productive more likely to challenge myself in other areas. As I become stronger physically, I?m doing the same mentally and becoming an all around better person.

New Growth in Hunting, Fishing Participation | Thinking Afield

FERNANDINA BEACH, Fla. ? When the U.S. Fish & Wildlife Service (USFWS) recently reported the number of hunters grew by nine percent since 2006 and the number of anglers grew by 11 percent in that same time frame, sportsmen and the sporting industry were thrilled. The numbers, which are preliminary results released as the initial look into the USFWS?s 2011 National Survey of Fishing, Hunting and Wildlife-Associated Recreation, reversed what had been dropping participation levels in fishing over the past 10 years and indicated the first jump in hunter numbers in more than two decades. But what were the reasons for the turnaround?

Rob Southwick, president of Southwick Associates, which is a leading research and data analysis firm focused on the sportfishing and hunting industries, says the evidence points to several key factors.

?The slow economy has certainly had an impact?, says Southwick. ?When the economy took a hit, a lot of people went back to enjoying more traditional activities that were also less costly than other options. Fishing license sales and tackle sales data all back that up.?

In addition to simple economics, on-going efforts to recruit new anglers are paying off. Southwick points to programs such as the Recreational Boating and Fishing Foundation?s Take Me Fishing National Campaign, which has been instrumental in introducing the spor to thousands of new anglers. Demographic shifts are also having an impact.

?Initial feedback indicates more baby boomers may be taking to the water?, says Southwick. The company and the USFWS will be looking at additional data in the coming months to identify other potential trends among youth and other segments of the angling community.

?We?ll be looking closely for shifts in youth and female participation. By the end of the year, we?ll know more?, says Southwick.

On the hunting side, the growth in participation is due to the same factors where the economy and recruitment programs are concerned.

?This is the first measured large increase in the number of hunters in years?, says Southwick. ?Conservation and firearms industry organizations have been particularly effective at communicating the benefits of hunting.?

Organizations such as the National Shooting Sports Foundation, the National Wild Turkey Federation and the U.S. Sportsmen?s Alliance all have programs geared toward growing youth and overall participation and have even teamed up to ease age restrictions that deterred many young people from participating in hunting. Additionally, expanded hunting opportunities such as allowing the use of crossbows in a number of states has made hunting more attractive to many new and returning hunters.

?Probably one of the most significant changes has been an apparent cultural shift regarding the acceptance and use of firearms?, says Southwick. Whether hunting or target shooting, many younger adults in their twenties and early thirties, are taking to shooting sports. Firearms sales have been strong for four years.? Whether this is attributable to returning soldiers with a newly found appreciation of the shooting sports or to adults who want to get outside after spending too much of their youth indoors, we need to learn more about the reasons behind the increase?,? says Southwick.

Southwick says there will be more details to come as his team reviews the data to identify more trends behind the growth in hunting and fishing and offers organizations the insight to keep these trends headed in a positive direction.

Poor monsoon rains hit millions of Indian farmers

KATHURA, India (AP) ? The farmer walks past muddy fields of stunted sugarcane and damaged rice paddies as a light drizzle falls. "Too late, too late," he says of the rains he has been praying for since many weeks ago.

For nearly two months, Satyavan Narwal's eyes scoured the heavens looking for the monsoon rains that would nourish his crops, but he found nothing and was left with parched earth. Now monsoon showers are soaking the fields ? but late August is much too late for him.

This year's fickle monsoon has played havoc with millions of Indian farmers. The showers, which normally run from June to September, are crucial in a country where 60 percent of the population works in agriculture and less than half the farmland is irrigated.

"Here farming is entirely on God's mercy. If nature doesn't bless us, the farmer can't do anything," Narwal says.

India's Meteorological Department has said it expects the country to get at least 10 percent less rain this year than during a normal monsoon, but large parts of the country have been hit much harder.

In the northwestern state of Haryana, where Narwal's family has farmed for generations, rainfall is less than half what it should have been. And when the rains finally did come, the crops were already nearly dead, fit only to be used as animal feed.

Shriveled old men share a water pipe and one of them points to the skies and shouts "What now, brother?" as they watch men and women carry damaged sugar cane to feed to their cattle. At the edge of fields, young men stand, hands on hips, shaking their heads in dismay. The village is 140 kilometers (87 miles) northwest of New Delhi.

By now the sugar cane crop should have been at least eight feet tall (2.4 meters tall). Rice paddy crops would have been lush and emerald green. Small patches of pearl millet, corn and sorghum would have dotted the landscape.

But the sun shone on with determination through all of July and most of August so that the cane is now only knee-high at best and most of the rice crop is burnt.

The lack of monsoon rains has also been partly to blame for the worst blackout in world history, which cut power to half of India last month. Large-scale farmers were using extra power to pump water from deep aquifers, and little electricity was being generated by hydropower projects.

Across the country rains in June and July ? a crucial time for farmers ? were nearly 20 percent below normal.

"Now some of the crop is so dry and damaged even our cattle won't eat it," says farmer Mahinder Singh, as he watches over the cleaning up of his sugar cane fields.

Punjab, the unofficial breadbasket of India, has received less than 40 percent of the rain it should have. Large swaths of western Gujarat and Maharashtra have been declared drought-stricken.

The government has said it's not worried about food scarcity because millions of tons of rice and wheat from earlier bumper harvests are spilling out of state-owned granaries.

But for the average farmer, who lives and earns from season to season, a poor monsoon means that food must be carefully rationed because he has little money to spend.

With dreams of a good harvest, most small- and medium-scale farmers borrow money, often at exorbitant interest rates, from local money lenders to buy seeds and fertilizers and hire tractors to plow the fields.

"Now even they won't give farmers money. They know there are no crops so there's no chance of recovery," said Ranbir Singh, as he cleaned up his three acres of dead sugarcane.

He already has to pay off loans of 300,000 rupees ($5,400), a fortune for a poor farmer.

"Now I will need to borrow more money to feed myself, but lenders will hold back," he said.

With nearly 70 percent of India's population living in rural areas, farming is vital to the economy. A poor monsoon is expected to further dampen already disappointing growth this year, according Citigroup economist Rohini Malkani.

Poor agricultural output could result in growth as low as 5.4 percent in the current fiscal year, down from the bank's earlier estimates of 6.4 percent, according to the economist's August report.

"If drought conditions worsen, headline growth could come in lower at 4.9 percent," she writes.

The federal government and many state governments have hesitated to declare a drought for fear of causing panic and because it requires them to assess each farmers' losses and compensate them.

Farmers in Punjab, Haryana and western Uttar Pradesh state, which have not been given declarations of drought, are losing patience.

"What will it take for the government to declare a drought?" asks Narwal. "Will all the farmers have to die first?"

Agriculture Minister Sharad Pawar said Cabinet ministers would meet later this week to discuss the impact of the poor monsoon.

In Kathura village, however, Pankaj Aggarwal, the top district official, brushes aside talk of a drought, saying that the few recent days of rain will revive the crops.

Meanwhile, farmers lament the lack of government investment in irrigation and other infrastructure that could protect farmers from the vagaries of the monsoon.

"Where are the irrigation canals, the irrigation pumps, the electricity supply that the government keeps promising the farmers?" asked Dharmendra Malik, a farmer and activist in Uttar Pradesh.

"You have food grains in your stocks so you're not worried, but that doesn't mean you abandon 600 million of your people who tend the fields," he said.

(AP) ? With its massive size and ponderous movement, Tropical Storm Isaac was gaining strength Monday as it headed toward the Gulf Coast. The next 24 hours would determine whether it brought the usual punishing rains and winds ? or something even more destructive harkening back to the devastation wrought seven years ago by Hurricane Katrina.

The focus has been on New Orleans as Isaac takes dead aim at the city, but the impact will be felt well beyond the city limits. The storm's winds could be felt more than 200 miles from the storm's center.

The Gulf Coast region has been saturated thanks to a wet summer, and some officials have worried more rain could make it easy for trees and power lines to fall over in the wet ground. Too much water also could flood crops, and wind could topple plants such as corn and cotton.

"A large, slow-moving system is going to pose a lot of problems: winds, flooding, storm surge and even potentially down the road river flooding," said Richard Knabb, director of the National Hurricane Center in Miami. "That could happen for days after the event."

The storm's potential for destruction was not lost on Alabama farmer Bert Driskell, who raises peanuts, cotton, wheat, cattle and sod on several thousand acres near Grand Bay, in Mobile County.

"We don't need a lot of water this close to harvest," Driskell said.

However, Isaac could bring some relief to places farther inland where farmers have struggled with drought. It also may help replenish a Mississippi River that has at times been so low that barge traffic is halted so engineers can scrape the bottom to deepen it.

Forecasters predicted Isaac would intensify into a Category 2 hurricane, with winds of about 100 mph, by early Wednesday around the time it's expected to make landfall. The current forecast track has the storm aimed at New Orleans, but hurricane warnings extended across 280 miles from Morgan City, La., to the Florida-Alabama state line. It could become the first hurricane to hit the Gulf Coast since 2008.

Evacuations were ordered for some low-lying areas and across the region, people boarded up homes, stocked up on supplies and got ready for the storm. Schools, universities and businesses closed in many places.

Still, all the preparation may not matter if flooding becomes the greatest threat. In Pascagoula, Miss., Nannette Clark was supervising a work crew installing wood coverings over windows of her more than 130-year-old home. But she said all that won't matter if a storm surge reaches her home, as it did after Katrina in 2005.

"The water was up to the first landing of the stairs," she said. "So I get very nervous about it."

Isaac's approach on the eve of the Katrina anniversary invited obvious comparisons, but Isaac is nowhere near as powerful as the Katrina was when it struck on Aug. 29, 2005. Katrina at one point reached Category 5 status with winds of over 157 mph. It made landfall as a Category 3 storm and created a huge storm surge.

Federal Emergency Management Agency officials said the updated levees around New Orleans are equipped to handle storms stronger than Isaac. Levee failures led to the catastrophic flooding in the area after Katrina.

"It's a much more robust system than what it was when Katrina came ashore," said FEMA Administrator Craig Fugate in a conference call with reporters.

In New Orleans, officials had no plans to order evacuations and instead told residents to hunker down and make do with the supplies they had.

"It's going to be all right," said New Orleans Mayor Mitch Landrieu.

Isaac could pack a watery double punch for the Gulf Coast. If it hits during high tide, Isaac could push floodwaters as deep as 12 feet onto shore in Louisiana, Mississippi and Alabama and up to 6 feet in the Florida Panhandle, while dumping up to 18 inches of rain over the region, the National Weather Service warned.

As of 8 p.m. EDT on Monday, Isaac remained a tropical storm with winds of 70 mph (110 kph). Its center was about 230 miles (370 km) southeast of the mouth of the Mississippi River, and it was moving northwest at 10 mph (17 kph).

On the Alabama coast, Billy Cannon, 72, was preparing to evacuate with several cars packed with family and four Chihuahuas from a home on a peninsula in Gulf Shores. Cannon, who has lived on the coast for 30 years, said he thinks the order to evacuate Monday was premature.

"If it comes in, it's just going to be a big rain storm. I think they overreacted, but I understand where they're coming from. It's safety," he said.

The storm left 24 dead in Haiti and the Dominican Republic, but left little damage in the Florida Keys as it blew past. It promised a soaking but little more for Tampa, where the planned Monday start of the Republican National Convention was pushed back because of the storm.

Only a fraction of an expected 5,000 demonstrators turned out in Tampa to protest GOP economic and social policies outside the convention. Organizers blamed Isaac and a massive police presence for their weak showing.

The storm had lingering effects for much of Florida, including heavy rains and isolated flooding in Miami and points north. Gov. Rick Scott said that as of Monday evening, about 80,000 customers were without power in Florida as a result of the storm.

Scott, a Republican, was returning from the convention in Tampa to Tallahassee to monitor Isaac. Fellow Gulf Coast Republican Govs. Bobby Jindal of Louisiana and Robert Bentley of Alabama said they would not attend the convention at all. Mississippi Gov. Phil Bryant delayed his travel through Wednesday, leaving open the possibility he could attend the final day of the event.

States of emergency were in effect in Louisiana, Mississippi, Alabama and Florida.

The choppy ocean waters generated by Isaac weren't all bad for everyone, though. On Pensacola Bay, fishermen boasted big hauls.

"You get a little storm headed this way and they seem to run a little. When the barometric pressure drops, something causes them to run better," said Eric Roberts, who was out fishing for mullet.

Best Buy-out: Wait 'til 2013? - The Term Sheet: Fortune's deals blog ...

FORTUNE -- Best Buy founder and former CEO Dick Schulze now has an opportunity to buy the troubled electronics retailer. But it's still going to be very difficult to do so in 2012.

Minneapolis-based Best Buy (BBY) this morning announced that it has agreed to let Schulze see the company's books, and to put together an investor group (something otherwise prohibited by Minnesota law). This comes after weeks of back-and-forth negotiations, much of which has taken place via press release.

The problem, however, is that Schulze still has just 60 days to present a fully-financed deal to Best Buy once he begins due diligence. He should be able to get private equity sponsors on board by then -- including co-investments -- but the banks could be a tougher sell. ?Remember, we're probably talking about $5 billion to $6 billion in debt here, and sources tell me that lenders are likely to want at least some earlier holiday sales data before committing.

Sixty days, however, won't even bring Schulze to Halloween (not exactly the holiday my sources were talking about). He may be entitled to a 30-day extension, meaning that his offer would have to be submitted on Friday, November 23. Perhaps he can get access the first few hours of Black Friday figures to the bankers, and send in his offer at 5pm.

Again, it's possible that Schulze pulls the financing together in time. But the likelihood is low.

By the way, do not think this timing is coincidental. Best Buy has been very clear about not wanting to negotiate throughout the critical holiday season, fearing that it would distract employees.

So here's my guess as to what happens: Schulze either doesn't submit a qualified offer in 2012, or submits one that includes certain material adverse change (MAC) terms related to holiday sales. Either way, Best Buy's board will probably reject the offer, thus setting the stage for Schulze to submit a revised offer in January 2013 -- possibly bringing it directly to shareholders if unable to receive board approval.

Best Buy stock is up more than 6% today, on news of the Schulze agreement. I hope the new buyers aren't planning to get taken out in 2012.

Apple's victory could mean fewer phone options

SAN JOSE, Calif. (AP) ? Apple Inc.'s $1 billion legal victory could mean fewer smartphone options for consumers to choose from, analysts said.

A federal jury's verdict Friday that Samsung Electronic Co. stole Apple's technology to make and market smartphones using Google's Android software sends a warning to other companies manufacturing similar devices, the biggest marketplace threat to Apple.

"Some of these device makers might end up saying, 'We love Android, but we really don't want to fight with Apple anymore,'" said Christopher Marlett, CEO of MDB Capital Group, an investment bank specializing in intellectual property. "I think it may ultimately come down to Google having to indemnify these guys, if it wants them to continue using Android."

That's if the verdict stands. Samsung, the Seoul-based global leader among smartphone makers, vowed to fight. Its lawyers told the judge it intended to ask her to toss out the verdict.

"This decision should not be allowed to stand because it would discourage innovation and limit the rights of consumers to make choices for themselves," Samsung lead lawyer John Quinn said. He argued that the judge or an appeals court should overturn the verdict.

Apple lawyers plan to formally demand Samsung pull its most popular cellphones and computer tablets from the U.S. market. They also can ask the judge to triple the damages from $1.05 billion to $3 billion.

U.S. District Judge Lucy Koh will decide those issues, along with Samsung's demand she overturn the jury's verdict, in several weeks. Quinn said Samsung would appeal if the judge refuses to toss out the decision.

Apple Inc. filed its patent infringement lawsuit in April 2011 and engaged the country's highest-paid patent lawyers to demand $2.5 billion from its top smartphone competitor. Samsung Electronics Co. fired back with its own lawsuit seeking $399 million.

The jury on Friday rejected all Samsung's claims against Apple, but also decided against some of Apple's claims involving the two dozen Samsung devices at issue.

It found that several Samsung products illegally used such Apple creations as the "bounce-back" feature when a user scrolls to an end image, and the ability to zoom text with a tap of a finger.

The U.S. case was the latest skirmish in a global legal battle between the two tech giants. Its outcome is likely to have ripple effects in the smartphone market. Other device makers relying on Android, the mobile operating system that Google Inc. has given for free to Samsung and other phone makers, may be more reluctant to use the software and risk getting dragged into court.

During closing arguments, Apple attorney Harold McElhinny claimed Samsung had a "crisis of design" after the 2007 launch of the iPhone, and executives were determined to cash in illegally on the success of the revolutionary device.

Samsung's lawyers countered that it was legally giving consumers what they want: smartphones with big screens. They said Samsung didn't violate Apple's patents and alleged innovations claimed by Apple were created by other companies.

Samsung said after the verdict that it was "unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners."

"This is by no means the final word in this case," Quinn said in a statement. "Patent law should not be twisted so as to give one company a monopoly over the shape of smartphones."

The jurors' determination that Samsung took Apple's ideas probably matters more to the companies than the monetary damages, Marlett said.

"I don't know if $1 billion is hugely significant to Apple or Samsung," Marlett said. "But there is a social cost here. As a company, you don't want to be known as someone who steals from someone else. I am sure Samsung wants to be known as an innovator, especially since a lot of Asian companies have become known for copying the designs of innovators."

Apple and Samsung combined account for more than half of global smartphone sales. Samsung has sold 22.7 million smartphones and tablets that Apple claimed uses its technology. McElhinny said those devices accounted for $8.16 billion in sales since June 2010.

Samsung's Galaxy line of phones run on Android, and ISI Group analysts viewed the verdict as a blow to Android as much as Samsung.

If Android lose any ground in the mobile computing market, that would hurt Google, too. That's because Google relies on Android to drive mobile traffic to its search engine and services to sell more advertising.

Google entered the smartphone market while its then-CEO Eric Schmidt was on Apple's board, infuriating Apple co-founder Steve Jobs, who considered Android to be a blatant rip-off of the iPhone's innovations.

After shoving Schmidt off Apple's board, Jobs vowed that Apple would resort to "thermonuclear war" to destroy Android and its allies.

The Apple-Samsung trial came after each side filed a blizzard of legal motions and refused advisories by the judge to settle the dispute out of court. Legal experts and Wall Street analysts had viewed Samsung as the trial's underdog. Apple's headquarters is just 10 miles from the San Jose courthouse, and jurors were picked from the heart of Silicon Valley, where Jobs is a revered technological pioneer.

A verdict came after less than three days of deliberations, surprising observers who expected longer deliberations because of the case's complexity.

While the issues were complex, patent expert Alexander I. Poltorak has said the case would likely boil down to whether jurors believed Samsung's products look and feel like Apple's iPhone and iPad.

Samsung's lawyers argued that many of Apple's claims of innovation were either obvious concepts or ideas stolen from Sony Corp. and others. Experts called that line of argument a high-risk strategy because of Apple's reputation as an innovator.

Apple's lawyers argued there is almost no difference between Samsung products and those of Apple, and presented internal Samsung documents they said showed it copied Apple designs. Samsung lawyers insisted that several other companies and inventors had developed much of the Apple technology at issue.

Apple and Samsung have filed similar lawsuits in South Korea, Germany, Japan, Italy, the Netherlands, Britain, France and Australia.

"This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple's claims," Samsung said in its statement.

Samsung won a home court ruling earlier Friday in the global patent battle against Apple. Judges in Seoul said Samsung didn't copy the look and feel of the iPhone and ruled that Apple infringed on Samsung's wireless technology.

But like the jury in California, South Korean judges said Samsung violated Apple's technology behind the "bounce-back" feature. Both sides were ordered to pay limited damages.

The Seoul ruling was a rare victory for Samsung in its arguments that Apple has infringed on its wireless technology patents. Samsung's claims previously were shot down by courts in Europe, where judges ruled that Samsung patents must be licensed under fair terms to competitors.

The U.S. case is one of some 50 lawsuits among myriad telecommunications companies jockeying for position in the burgeoning $219 billion market for computer tablets and smartphones.
